초록[abstracts]
[인공지능의 출현은 인류에게 여러 면에서 생활의 편의를 제공하고 있으며 동시에 많은 위험성을 내포하고 있다. 또한 초고도의 인공지능이 출현하여 인간의 지성을 능가하는 소위 기술적 특이점이 머지않아 도래할 것으로 예측되고 있고 그에 따른 인류사회에의 영향이 어떠할 것인지 의견이 분분하므로 그에 대한 대응이 시급한 시점에 도달했다고 판단한다. 특히 초고도 인공지능에 대하여 어떠한 법적 지위를 부여할 것인지에 관하여는 최근 법학의 쟁점이 되고 있으며 앞으로도 활발한 후속연구가 수행될 것으로 기대한다. 현행법체계에서의 사람과 물건의 이분법적 권리의 주체·개체 관념을 완전히 벗어날 수는 없으나 종래 시대와 국가를 초월하여 人(자연인·법인) 이외의 존재에 대하여 일정한 법적 지위를 부여한 사례를 검토하여 향후 입법의 방향을 제시하고자 하였으며 현행법상의 재단법인의 형식을 빌려 인공지능에게 법인격을 부여하는 방식의 시론도 시도하였으나 그 논리적 타당성은 차치하고라도 이를 일반화하는 데는 많은 제약이 있는 것이 사실이나 이에 대한 앞으로의 후속 연구가 활성화 되기를 기대한다.
With the help of technological development of artificial intelligences, there comes not only an astonishing convenience in human life, but also a dreadful fear for the future, Especially, so called ‘the technological singularity’, that is the critical point when the intelligent capacity of artificial intelligences pass over that of human beings, will come in a near future; a scholar predicted it might be earlier than A. D. 2045. Nobody can dare to predict what would happen then, but mankind should be prepared for the future society. as to the question what status for the artificial intelligence robots much more smarter than ordinary human beings in various aspects should be established, is the main issue in legal society, as like other academic world; which will be much more stronger for the time being until the doom’s day has come. Under current legal system, dichotomy of the legal subject on the legal persons like human beings; and the legal object on the other beings such as things like a machine has long been a basic principle in civil law regime; this article, however, is dedicated to search cases where non-per beings has been treated as legal persons in a certain way all through the times and nations; so to propose a plausible legislative steps for the future. With all other discussions, a new approach to give a legal personhood on the artificial intelligences borrowing the forms of the juristic foundation under current civil law system; which would be an arguable misunderstanding of the statutes and valid legal theories; which could be, for all the theoretical refines or justifications, provoking more refined researches among the legal society.]
