초록
A house is a starting point of the home and a basis for comfortable and pleasant life. Men``s efforts for enjoying more pleasant life even under city centralization led to development of brilliant architectural technology. Today, with regard to and against an act of newly building constructed a building on one``s own land after getting legal building permission for plenty of security of sunshine amount, nearby house owners frequently asset right to sunshine, resulting in occurrence of disputes. Media reports of trial results of these disputes and voices for demanding essential and institutional solutions to the present disputes of right to enjoy sunlight sunshine are expanding. At the present time, the problems occurring between neighbors can be settled only by civil laws not by public laws, which causes emotional problems. Like this, in spite of the fact that disputes about right to sunshine are increasing day by day under the situation in which city centralization of populations leads to urbanization, overcrowding and manhattanization, Building Act enacted under the present situation in which the Korean government stresses a policy of efficiently supplying houses is forced to be passive in protection of right to sunshine or right to environment, etc. Therefore the right to sunshine should be handled from the viewpoint of protection of national basic right.
