이 논문은 정밀의료 연구 또는 산업에서 개인정보를 불가피하게 수집 · 이용함으로써 제기될 수 있는 주요 쟁점들을 짚어보고 이에 대한 정책방향을 제시하기 위한 것이다. 다만, 국내의 경우 아직 정밀의료의 구체적인 개념이나 특징이 정의되어 있지 않아 본 논문에서는 미국의 ‘Precision Medicine’ 의 개념을 바탕으로 연구를 진행하였다. 먼저 정밀의료의 주요 개념과 기존 의학연구들과 대비되는 특징(코호트, 수집 정보의 종류, 기반 기술)들을 살펴보았고, 정밀의료에서 개인정보가 지니는 가치를 조명하였다. 또한 정밀의료에서 제기될 수 있는 개인정보 쟁점으로 사생활 침해, 유전자 차별과 같은 정보 보호관점에서의 문제들을 짚어 보았고, 정보의 수집 · 이용 시 현행 개인정보보호법과의 상충문제도 예상하였다. 이를 중심으로 외국의 주요 입법례를 살펴본 후 우리나라 법제도와의 비교 분석을 실시하였다. 현행법의 개정 또는 특별법 제정과 같은 법적근거의 마련이 절실히 요구되며, 정밀의료에 참여하는 개인을 보호하기 위한 법 제도의 정비도 반드시 필요하다고 보았다. 저자들은 본 고찰을 통해 국내에서의 정밀의료 추진과 정책방향 설정에 도움이 되고자 한다.

This article aims to analyze the issues that may arise from the handling of personal information in precision medicine research and to suggest policy directions for precision medicine in Korea. To do this, we reviewed the key features of precision medicine research and characteristics (cohort, collected information, based technology, etc.) compared with existing medical researches and highlighted the value of personal information in precision medicine. In addition, we examined privacy issues such as invasion of privacy, conflicts with current privacy laws, and prohibition of genetic discrimination in foreign medical legislation. The results of this study are as follows. First, the legal basis for using personal information was needed in the precision medical research and the revision of the personal information protection law or the special medical law were required. In addition, we considered that it is necessary to prepare more specific regulations when considering the development of analysis technology of genetic information, which is the core information in precision medical research and the damage caused by leakage of information. Through this article, we intended to contribute to the establishment of the policy direction and the promotion of researches for precision medicine in Korea.
