- 이 논문은 신무기기술의 사용과 관련되는 국제인도법의 법적 문제를 다룬다. 현행무력충돌은 새로운 교전행위자의 출현과 더불어 신무기기술의 등장을 끊임없이 접하고 있다. 이는 물론 군사부분의 지속적인 기술발전의 결과이기도 하다. 국제인도법적 관점에서 신무기기술의 이슈를 분석하기 위해, 우선 국제인도법의 목적, 기본원칙 그리고 국가관행을 검토하였다.
본 논문은 크게 7개 부분으로 구성된다. 첫 부분은 서론, 둘째는 신무기기술과 국제인도법, 셋째는 사이버 전투와 국제인도법, 넷째는 원격조정무기와 국제인도법, 다섯째는 로봇무기와 국제인도법, 여섯째는 국제인도법적 평가, 일곱째 결론으로 이루어진다.
본문은신무기기술 사용과 국제인도법의 적용에 대한 법적 평가에서 다음의 결론으로 마무리한다.
첫째, 모든 토론은사실(facts)에 대해 불확실성을 보여주었다.
둘째, 신무기 기술이 군인을 전쟁터로부터 더욱 멀게 한다는 사실은 반복되는 토론의 주제였다.
셋째, 특정무기의 민간인에 미치는 영향은 아직도 투명하지 않다는 점이다.
넷째, 반복되는 주제는 신기술의 도입에서 오는 책임과 설명 문제가 남아있다.
다섯째, 가장 반복적인 화두는 기술 자체는 좋은 것도 나쁜 것도 아니다.
여섯째, 신무기사용과 관련하여 국제인도법 원칙 적용에서도 긍정적 평가보다는 부정적 평가가 더 우세하다고 본다.
결론적으로 어떠한 신무기기술이 무력충돌현장에 등장하여도 반드시 국제인도법의 실천원칙의 핵심인민간인보호를 항상 보존하여온 최소한 “구별의 원칙”(The principle of distinction)과 “비례의 원칙”은 반드시 준수되어야 한다고 본다. - 초록 (Abstract)
- This article treats with international humanitarian legal Issues on Use of New Weapons Technology.
Contemporary armed conflicts have increasingly seen the emergence not only of new actors but also of new armament technologies, which have resulted from the continuous technological development in the field of defense. In order to discuss the issues of New Weapons Technology from the perspective of international humanitarian law (“IHL”), we first examine the aim, concept, basic principles, and practice principles of IHL
This article have five main points as follows: 1) Regulations of New Weapons Technology and International Humanitarian Law; 2) Cyber Warfare and International Humanitarian Law; 3) Remote-controlled Weapon Systems and International Humanitarian Law; 4) Automated Weapon Systems and International Humanitarian Law’ 5) Analysis and Evaluation from the Perspective of “IHL”.
We could summarize the debate sin sixa for esaid points. : First, all debates regarding new weapon technology show uncertainty on facts. It is not always clear what is technically feasible in today’s theatres of war, and less clear what will be feasible in the future and when.
Second, the fact that new weapon technology allows soldiers to act faraway from the battlefield is an old debate. Many discussants pointedout that remoteness of the soldier to the enemy is nothing.
Third, the effects of certain weapons on civilians is still not clear. Forinstance, there is controversy about the effects of drones: no one appears to know with any measure of certainty the loss of civilian lives, injury to civilians and damage to civilian infrastructure that has been by drone attacks.
Fourth, the repeated subject was the responsibility and accountability for violations regarding development of new weapon technology.
Fifth, the most repeated topic was technology is neither good or bad.
Sixth, A negative side of the new weapons technology would be the more prevailing than their positive sideregarding implementation of basic principles of international Humanitarian law.
In conclusion, what I want to emphasize is that no matter what kind of newwea pons technology appear in the site of armed conflicts, the principle of distinction, the principle of proportionality and the principle of precaution of IHL, as implementation principles for the protection of civilians, must be followed. - 목차 (Table of Contents)
