낙태에 대한 개방적 접근의 필요성

초록[abstracts]
[한국은 제한적인 낙태 정책으로 인해 국제사회로부터 여러 차례 지적을 받아왔다. 이는 인권침해의 위험이 크기 때문이기도 하지만, 보건학적 측면에서도 바람직하지 않기 때문이다. 법적 제한은 많은 여성을 기술적으로 부족한 시술자에게 낙태시술을 요구하게 만들거나 비위생적 환경에서 낙태시술을 받도록 해 큰 위험에 노출시킬 뿐이다. 낙태를 법률로 제한한다고 해서 낙태 건수가 줄어드는 것도, 출생률이 극적으로 증가하는 것도 아니다. 반대로 안전한 낙태 서비스에 대한 접근성을 촉진하는 법률과 정책이 갖추어졌을 때 낙태율과 낙태 건수가 줄어드는 경향을 보인다. 더욱이 한국에서의 폐쇄적인 낙태 정책은 일제에 의해 시작된 것으로 한국의 전통이나 문화와는 거리가 멀다. 현재 여론 역시 낙태죄 폐지에 대해 긍정하고 있다. 이처럼, 역사 및 보건학적 관점에서는 물론, 시대적인 상황, 여론, 인권, 정치, 외교 등 거의 모든 영역에서 그 당위성이 확인되고 있는 만큼 낙태 관련 정책이 보다 개방적인 방향으로 나아갈 필요가 있다.
Korea has been pointed out several times from the international community because of its backward abortion policy. This is because not only there is a high risk of human right violations, but also it is desirable to abolish the abortion punishment regulations that can hinder the accessibility to medical services by women from the perspectives of public health. That is, restricting abortions by law does not reduce in the number of abortions and does not increase the birth rate dramatically as well. On the other hand, laws and policies that promote the accessibility to safe abortion services tend to reduce the number of abortions. Legal restrictions can only expose many women to huge danger by making them undergo an abortion in other countries, ask for an abortion from an unskilled abortionist, and have an abortion at an unsanitary place. In addition, the closed abortion policies are far from Korean traditions and cultures. Recently, the consensus is for the abolition of illegal abortion. Since the appropriateness of abolition is verified in almost all areas excluding religions, such as the times, public opinions, health care, politics, and diplomacy, the policies on abortion should go in more open directions.]
