초록[abstracts]
[원하지 않은 아이를 임신한 여성의 권리를 외면할 수는 없다. 강요된 출산이 여성의 삶에 미치는 영향이 가혹할 수 있기 때문이다. 그러나 태아의 생명 또한 법의 보호가 필요없을 정도로 가치가 없는 것은 아니다. 태아는 비록 여성의 몸속에 존재하고 있지만 법으로 보호되어야 할 인간생명체이다. 우리 형법은 합법적 임신중절의 범위를 너무 좁게 본다. 사회경제적 사유로 인한 임신중절이 전혀 배제되어 있다. Pro Life 지향적이다. 미국은 임신중절을 너무 쉽게 허용한다. Pro Choice 지향적이다. 태아의 생명을 보호하는 방안에 대하여 진지하게 고민해야 할 시점이다. 독일식 상담규정은 Pro Life와 Pro Choice를 절충하고 있다는 점에서 매우 설득력이 높다. 태아의 생명보호라는 가치를 훼손하지 않으면서, 산모의 자기결정권을 제한하지 않는 독일식 상담규정이 문제해결을 위한 좋은 대안이 될 수 있다. 낙태허용국가에서 낙태율이 떨어진다는 주장은 독일식 상담규정의 장점을 잘 설명하는 것이라 할 수 있다.,
You can not ignore the rights of a woman who is pregnant with an unwanted child. The impact of forced childbirth on women"s lives can be severe. However, the life of the fetus is not without value as it does not require the protection of the law. The fetus is a human life form that should be protected by law, although it exists in the female body. Our criminal law looks too narrow the scope of legitimate abortion. Pregnancy termination due to socioeconomic reasons is completely excluded. Forcing women to give birth in a situation where the protection and support of the unmarried mothers is poor, especially for women who are forced to make a living every day, will be a great burden that can not be overcome by the state. Of course, socioeconomic reasons are ambiguous and there are concerns that the reasons for acceptance may be too much, and as a result, the provisions for self-abortion may be sourced. Pro Life is oriented. The United States allows abortion too easily. Pro Choice is oriented. It is time to seriously consider how to protect the life of the fetus. German counseling is highly persuasive in that it compromises Pro Life and Pro Choice. A German-style counseling rule that does not limit the mother"s right to self-determination without compromising the value of the life protection of the fetus can be a good alternative for solving problems. Some argue that the abortion rate is falling in the countries where abortion is permitted. Rather, “the abortion rate falls in the countries where abortion is allowed” is a good explanation of the advantages of the German counseling rule.]
