초록

나고야의정서는 상품생산 이전 단계인 유전자원의 이용단계를 규율하기 위해 체 결되었음에도 불구하고,

유전자원 이용에 따른 이익공유를 미연에 확보하기 위한 교 역제한조치가 수반되는 경우 GATT와 상충되는

경우가 발생할 수 있다. 비대칭적인 접근허가 및 이익공유 조치는 내국민대우 의무 위반 주장을 제기할 수

있으며, 일정 한 유전자원에 대한 수출제한 조치나 일정한 수입대상자에 대한 수출제한 조치는

GATT의 수량제한 금지원칙 위반을 야기하게 된다. 또한 각국이 유전자원을 이용한 제품의 특허출원시,

해당 유전자원의 출처의 공개 를 강제하는 제도를 운영하거나, 이익공유를 하지 않은 발명에 대한 특허권

부여를 거부하는 제도를 도입하는 경우, 이것이 신규발명품에 대한 특허권을 보장하는 TRIPS협정과

충돌하는 문제가 발생할 수 있다. 앞으로, 생물다양성 보존과 이익공유 문제가 더욱 중요한 국제문제로

  부각되고, 나고야의정서가 명실 공히 다자협정으로 정착되게 되면, 의정서와 WTO협정 간의 조화를

위한 입법노력을 기울일 필요가 있다. GATT와 TRIPS협정상의 환경보호 관 련 예외규정들의 전향적인

해석 및 개정을 통해 이러한 조화를 달성해나가야 한다. 이것은 전 세계적 환경문제가 점점 심각해지는

상황에서 국제통상규범도 가급적이 면 환경 친화적으로 해석되고, 환경규범을 지지(support)하는 방향으로

  적용될 책임 이 있음을 의미한다.

초록

The Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits

Arising from Their Utilization is intended to internationally regulate the utilization stage of genetic

resources prior to the production stage of trading commodities. If this regulation is materialized

 in the form of trade measures that is aimed to secure the benefit sharing, it becomes inevitably

in conflict with the GATT rules aiming to liberalize international trade. Any unbalanced access and

benefit sharing measures for foreign and domestic resources may cause violations of the national

treatment principle under the GATT and export restriction measures against certain resources or

 users may trigger inconsistency with the principle of general prohibition of quantitative restrictions

of GATT. In addition, any requirement of disclosure of origin of genetic resources or the benefit

sharing as a condition of providing patent protection might result inconsistency with patent right provisions

 under the TRIPS Agreement. As the issue of conserving biological diversity and benefit sharing emerges

critical global concerns and if the Nagoya Protocol functions as a genuine multilateral treaty in the future,

 the international society needs to make legislative efforts to harmonize the rules of the Protocol and the

WTO. Relevant provisions under the GATT and TRIPS need to be interpreted in a more

  environment-friendly way and any possibilities of revising current exception clauses need to be explored

. In the global crisis of ailing environment and biological diversity, it is about time for the multilateral trade

 norm to take its due responsibility to support the prevailing principles of global environmental regimes.
