웰다잉법의 시행을 둘러싼 제 문제
= Problems Surrounding the Implementation of Well-dying Law

A well-dying law is to secure patients’ interest and to respect their decision at the last minute of life. Even though there were many different opinions during the legislative process, the law was established according to a social agreement that the matter of facing death naturally by quitting life prolonging treatment as patients’ own decision is to practice constitutional value of protecting life right. The well-dying law legally solved the discontinuity of life prolonging treatment for hard case patients, which caused a lot of social disputes. The law is meaningful in that it gives doctors the legitimacy of discontinuing life prolonging treatment and acknowledges the right of patients’ dignified death. In addition, the law bans the discontinuity of life prolonging treatment done by the agreement between doctor and patient’s family without reflecting the patient’s opinion, and it established legal and institutional foundation for patients in the process of death to switch to well-dying that they can receive the best care. Nevertheless, the well-dying law could be used for a method of finishing patients’ life too easily along with encouraging mercy killing, so the law should be implemented with its intention reflected correctly. That’s why there are a lot of problems to implement the law in the medical field just in 1 year despite good intention of respecting patients’ self-determination right and protecting human dignity and value. As the life prolonging treatment decision system is implemented, our society can be considered to take the first step towards well-dying and dignified death. To settle the well-dying culture in our society, this study is intended to research the process of implementation and to draw some tasks to improve the law.
국문 초록[abstracts] 웰다잉법은 삶의 마지막 시기에 환자의 이익을 보장하고 자기결정을 존중하기 위한 법이다. 웰다잉법의 입법 과정에서 다양한 견해 차이가 있었지만, 환자 스스로 자기결정권을 행사하여 연명의료를 중단하고 자연스러운 죽음을 맞이하는 문제는 생명권 보호라는 헌법적 가치를 실현하는 것으로 사회적 합의에 따라 제정되었다. 웰다잉법은 그동안 사회적으로 많은 논쟁을 불러일으켰던 회복 불가능한 연명의료의 중단을 법적으로 해결한 것으로 의사들에게 연명의료중단 행위에 대한 정당성을 마련해 주었으며, 임종과정에 있는 환자의 의사에 따라 존엄하게 죽을 수 있는 권리가 인정되었다는 점에서 그 의의가 크다. 또한 의료현장에서 환자의 의사(意思)는 배제된 채 담당의사가 환자가족과 상의해 음성적으로 시행되어 온 연명의료중단이 금지되었으며, 임종과정에 있는 환자가 최선의 돌봄을 받을 수 있는 웰다잉(well-dying)으로의 전환할 수 있는 법적ㆍ제도적 근거를 마련하였다는데 그 의의가 있다. 그러나 웰다잉법은 입법취지에 따라 임종을 앞둔 환자가 존엄하게 죽음을 맞이할 수 있게 도와주는 역할을 하지만, 오히려 안락사를 조장하고 생명을 손쉽게 마감할 수 있는 방편으로 오도될 여지가 있기에 법 시행의 취지가 제대로 반영되고 실현되어야 한다. 따라서 환자의 자기결정권을 최대한 존중하여, 인간으로서의 존엄과 가치를 보호하고자 했던 연명의료결정제도의 좋은 취지에도 불구하고, 제도가 시행된 지 1년이 지난 지금도 의료현장에서는 많은 어려움이 있는 것이 현실이다. 1년 남짓 연명의료결정제도를 시행하면서, 이제 우리 사회가 웰다잉-존엄한 죽음이 있는 사회로 가기 위한 중요한 첫걸음을 내 딛었다고 평가할 수 있다. 이렇게 막 시작된 웰다잉의 문화를 우리 사회에 더욱 뿌리내리기 위하여 그간의 시행 과정을 살펴보고, 개선해 나가야 할 과제들을 도출해 보고자 한다.
