- 사람들은 자신의 생의 마지막을 어떻게 마무리할 것인지에 대해 진지한 고민을 하면서 고통없이 자연스럽게 생을 마감하길 원한다. 그러나 죽음은 누구도 결정할 수 있는 문제는 아닐 뿐만 아니라 인위적으로 그 죽음에 이르도록 하게 하여서도 안 된다. 인위적 죽음과 관련하여 우리 사회는 안락사, 존엄사, 연명치료중단 등 다양한 논의를 진행하여 왔다. 이러한 논의의 결과로 그동안 안락사 허용문제와 관련하여 제출된 7건의 법안을 통합하고 조정하여 제정된 법이 연명의료결정법이다. 이 법은 형법상 범죄로 될 수 있는 의료행위의 범죄화 영역을 비범죄화하는 내용을 담고 있으며, 이를 법적으로 그 정당성을 담보한 것이라 할 수 있다. 이러한 입법적 결단은 연명의료결정법의 목적에서 밝히고 있는 ‘환자의 최선의 이익을 보장하고 자기결정을 존중하여 인간으로서의 존엄과 가치를 보호’할 수 있을 정도로 완결한 것인지 의문이 든다. 왜냐하면 회복불가능한 연명치료를 중단함에 있어서 법적으로 해결한 것으로 의사들에게 연명의료중단행위에 대한 법적 근거를 마련해 주고, 환자에게는 존엄하게 죽을 권리를 인정하였다는 긍정적인 면이 있다. 그러나 연명의료 중단의 허용대상 범위의 문제, 연명의료중단등결정의 불분명한 의학적 판단기준의 문제, 환자의 자기결정권의 문제 그리고 벌칙규정의 문제 등 여러 부정적인 면이 상존하고 있기 때문이다. 연명의료결정법은 2017년 8월 4일부터 시행되지만 연명의료중단결정에 관한 사항은 2018년 2월 4일부터 시행될 예정이다. 다양한 논의와 함께 사회적 공감대가 형성된 것이라 하더라도 부정적인 면이 다수 존재하고, 반드시 이를 수정해야 할 필요성이 강하게 제기된다면 이를 해소하는 것은 당연한 수순일 것이다. 무엇보다 연명의료결정법은 사람의 생명을 인위적으로 단축하는 것으로 신중에 신중을 기해야 한다. 따라서 지금까지 제기된 문제를 다시 논의하여 연명의료결정법은 제정 당시의 목적을 충실히 달성할 수 있는 방향으로 신속하게 개정되어야 할 것이다.
- 초록 (Abstract)
- life naturally without pain. Yet, death is not a problem for anyone to decide, and we must not let anyone die artificially. Regarding artificial death, different discussions have been on in our society including euthanasia, death with dignity, and withdrawal of life sustaining treatment. As the result of these discussions, the law legislated through the combination and adjustment of 7 bills submitted in relation to the permission of euthanasia so far as for the problem of the approval of euthanasia is the Act of Hospice Palliative Care and Withdrawing Life Sustaining Treatment. This law includes decriminalization of the criminal medical acts that can be regarded as offense by the criminal law, and guarantees their legitimacy by law. It is questionable whether this legislative resolution is complete enough for a patient s best interest to be secured, for self determination to be respected and for dignity and value as a human being to be protected as clarified in the purpose of the Act of Hospice Palliative Care and Withdrawing Life Sustaining Treatment. It has legally settled the suspension of life sustaining treatment with an irreparable injury, and has the positive aspects that it has found legal grounds for doctors to stop life sustaining treatment and acknowledged a patient s right to die with dignity. However, there are many negative aspects, too, for instance, the matter of the permissible range of the withdrawal of life sustaining treatment, uncertain standards for medical judgements, such as the withdrawal of life sustaining treatment, a patient s right of self-determination and penal provisions. The Act of Hospice Palliative Care and Withdrawing Life Sustaining Treatment will be enforced from August 4th, 2017, but the matters connected with the decisions of withdrawing life sustaining treatment will be implemented from February 4th, 2018. Even though social consensus has been formed along with diverse discussions, if there are many negative aspects, and the necessity to correct them definitely has been raised strongly, solving the problems will be a natural step. Above all, the Act of Hospice Palliative Care and Withdrawing Life Sustaining Treatment is to shorten a person s life artificially, and requires close attention and cautions. Therefore, the Act of Hospice Palliative Care and Withdrawing Life Sustaining Treatment should be revised rapidly through re-discussion on the problems raised so far so that it can accomplish the goal set at the time of legislation fully.
