초록[abstracts]
[In the 21st century, it is time to see the coming of the Fourth Industrial Revolution by fusion of technology that disrupts the boundaries between digital technology and ICT, physics, and biology. The characteristic of the fourth industrial revolution that is already in progress is the convergence of technologies such as digital, bio, and offline, and artificial intelligence (AI) is at the center. Artificial intelligence has been developing more rapidly in recent decades, and thousands of artificial intelligence applications are already digging deep into the infrastructure of every industry. Intellectual property systems, on the other hand, are dual-faceted systems that can harm monopoly rights while harming fairness. There is a fair trade system that is in conflict with the intellectual property system and plays an optimal balance by correcting the rules of innovation and competition in a balanced way. The Fair Trade Act is an institutional device designed to ensure the principle of competition that is the basis of the efficiency and democracy of capitalist society. Fairness is another value that must be ensured in that it can not ignore the principle of competition while protecting the motivation and creativity of innovation in establishing an intellectual property strategy.
21세기 현재 디지털기술과 정보통신기술(ICT), 물리학, 생물학 등 각 학문의경계를 허무는 기술의 융합에 의한 제4차 산업혁명의 도래를 눈앞에 두고 있는시점이다. 이미 진행과정에 있는 4차 산업혁명의 특징은 디지털, 바이오, 오프라인 등의 기술을 융합하는 것이고, 그 중심에는 인공지능(AI: Artificial Intelligence) 이 자리 잡고 있다. 최근 10년 사이 인공지능은 더욱더 빠르게 발전하고 있으며, 이미 수천 종의 인공지능 응용프로그램들이 모든 산업의 기반 구조 깊숙이 파고들고 있는 상황이다. 세계경제포럼(WEF)의 창시자 클라우스 슈밥 회장은 4차 산업혁명의 AI시대에는 지식재산제도가 바로 국가의 핵심역량이자 성장동력이 될 것이라고강조했다. 이러한 상황을 반영하듯 세계의 각 국가들은 앞을 다투어 4차 산업혁명과 지식재산권 보호전략을 세워 미래의 국가 성장동력을 마련하기에이르렀다. 이와 같은 변화의 소용돌이 속에서 제4차 산업혁명은 우리 곁에 다가와있고, 그 사회의 특징은 ‘지능정보사회’가 될 것이다. 지능정보사회의 특징은인공지능(AI), 사물인터넷(IoT)에 의한 초연결사회이며, 이러한 사회를 나타내는 시대명칭을 ‘AI시대’라고 이름 붙이면서, 이하에서는 AI시대에 있어서지식재산권이 국가역량 확장의 신동력이 될 것이라 생각하며, 4차 산업혁명에 대한 지식재산권 보호에 관한 국가전략과 입법정책에 대하여 법적 체계를 확립하기 위한 시론을 펼치고자 한다.]
