본 논문에서는 생명공학발명과 줄기세포치료제의 특허허여 여부를 살펴보고, 의료방법이 “산업상 이용가능성”에 대하여 한국, 미국, 유럽, 일본의 입법례를 비교하였다. 또한 한미 FTA에 따라 시행된 복제약 시판허가·특허 연계제도에 대하여 고찰하였다.
생명공학기술의 산업화는 1982년 미국 FDA의 승인을 획득한 유전자 재조합 인슐린을 필두로 생명공학 신제품들이 시장에 등장하면서 본격화되기 시작하여, 현재 생물의약, 생물전자, 생물화학, 바이오식품, 생물농업, 생물환경 등 다양한 생물산업군으로 발전하고 있으며, 휴먼게놈프로젝트(Human Genome Project)가 완료됨에 따라 비약적인 성장이 예상된다.
특히 줄기세포 치료제에 대하여 성체줄기세포에 관한 출원과 수정란 배아줄기세포에 관한 출원이 국내 특허출원의 대부분을 차지하고 있다. 식약청의 품목허가를 계기로, 앞으로 줄기세포 치료제에 관한 연구개발 투자가 크게 확대되고, 특허출원도 큰 폭으로 증가하고 있다.
특히 배아줄기세포는 성체줄기세포에 비해 다른 조직이나 장기로의 분화능력이 뛰어나 다양한 난치성 질환을 치료해 줄 수 있을 것으로 기대된다. 우리나라는 대학, 연구소 및 바이오벤처 기업에서 활발한 연구활동을 벌이고 있다. 이러한 연구개발 의지가 국가의 차세대 성장 동력으로 연계되어 꽃이 피울 수 있도록 지속적인 투자가 필요하다.
최근 생명공학적 검사 방법 또는 기기를 이용한 진단방법으로 특허출원이 급증하고 있는 추세를 감안할 때 산업상 이용할 수 없는 진단방법에 대한 정의 및 통일된 심사기준 마련되어야 할 것으로 판단된다.
한미 FTA를 통해 도입되는 의약품 허가－특허 연계제도가 2012년 3월 15일부터 시행되고 있다. 국내 제약회사와 전문가들이 제기한 문제점들은 해당 유예기간 내에 반드시 우리나라의 국익에 도움이 되는 방향으로 정비 또는 개선되어야 할 것이다. 복제약 시판허가에 따른 의약품 특허권 침해에 대한 국내 사법적 구제를 보다 효과적으로 운용할 수 있도록 법과 제도가 개선하여야 한다. 의료 관련 발명의 특허권 보호는 우리 경제의 혁신역량을 강화하기 위해 필요한 정책이므로 이에 대한 꾸준한 연구가 필요하다.

This paper reviewed patent grants for inventions of the bioengineering and the stem cell medicine and compared the application of the law in Korea, United States, Europe, and Japan for “Industrial Utility” of the treatment. Furthermore, the sanction of generic drugs and the approval-patent linked system was examined as they were enforced by the South Korea-United States Free Trade Agreement.
Industrialization of the bioengineering started in earnest in 1982 as the Food and Drug Administration in the U. S. approved new bioengineering products such as the genetic recombination insulin made their first appearances in the market. Today, the industrialization has largely expanded to various biotechnology industries such as biologic medical, biologic electronics, biologic chemical, biologic food, biologic agriculture, and biologic environment. In addition, its rapid development is expected along with a completion of the Human Genome Project. Particularly, in the case of the stem cell medicine, applications for the adult stem cell and the fertilized egg embryonic stem cell are taking major portion of domestic patent applications. Along with the license approval by the Korean Food and Drug Administration, investments in the stem cell medicine researches may expand and there has been a massive surge in the number of patent applications.
In particular, because the embryonic stem cell has outstanding differentiation ability to other tissues or organs compared to the adult stem cell, it is expected to cure many intractable diseases. In South Korea, universities, science laboratories, and bio-venture corporations are vigorously conducting related researches. To link such research development efforts to future growth engine of the country, continuous investment is essential. Because there have been many patent applications for the diagnostic methods using biotech-tests or devices, defining the diagnostic methods and unified standards are needed.
The approval-patent linked system for medicine and medical supplies will be initiated on March 15, 2015 by the South Korea-United States Free Trade Agreement. During a grace period, points that domestic pharmaceutical companies and experts have raised must be considered and ameliorated in order to result favorable outcomes to South Korea. Along with the approval of generic drugs, legal and institutional systems should be improved for more efficient implement of domestic jurisdictional aid for infringement of the medicine and medical supplies patents. Continuous study is also required to protect patents in the method invention for medical treatment because it is a necessary policy to enhance innovation capability of domestic economy
