초록
Until the September of 2016, there are approximately 51,555,409 million people living in our country, and among them, senior citizens above 65 years old account for about 13.2% reaching towards 6.6 million in total. The aging speed of Korean society is the fastest among the countries of OECD. It is expected to become a super aged society in which the 20% of entire population is above 65 years old in 2030. The increase in the number of senior citizens who are healthy, yet solitary will become a prominent social problem, and the current social security system will not be able to cope with this rising number of elderly people. I recommend, in this paper, that the current passive and unilateral legislations related with the problems of the elderly change to more active ones based on senior citizen volunteering activities, and further improve through the involvement of senior human resources in the social problems such as the decline of human resources in production. Nowadays, the population of the elderly is skyrocketing due to the improvement in the average life span, and senescence is becoming the longest period in an individual``s entire life. Meanwhile, knowledge and experience possessed by the senior citizens is no longer demanded in the current fast changing society, hence, the elderly are having difficulties adopting themselves to the society. A human being has his or her own life cycle that starts from the birth, passing through the prime season of youth, and reaching to the aged period where anyone gets old and weak. However, our national system that has to act as our future safe net is not fully prepared as a reliable legal system to the super aged society of 2030 which will come 14 years later. Governmental reaction to the social uproar of the elderly issues has always been improvised and conciliatory, resulting in the growing number of intended beneficiaries not receiving the help. In order to overcome the current inefficiency, we have to vitalize the senior citizen volunteering activities and supplement the welfare for the aged to appropriately react to the social changes. We believe setting a proper aim as a welfare state is critical to obtain sustainable growth in times of current severely-aging era. Thus, we want to bring up the need of the enactment of "Fundamental Civil Welfare Legislation" not because we want to collapse the ``the rule of law`` principle, the most important ideology in a constitutional state, but because we hope to resolve the current dysfunction of the legal system supporting the arbitrary administrative decisions on the elderly issues in this critical moment.
