줄기세포사업이 성장함에 따라, FDA는 허가받지 않은 줄기세포치료제 판매를 줄이고, 궁극적으로 없애기 위한 집행활동을 계속해야 함.
# 사례1 : 세 명의 여성은 2015년에 플로리다의 클리닉에서 줄기세포를 눈에 주사한 후 실명됨. FDA와 법무부(Department of Justice)는 결국 2019년 6월에 이 클리닉에 대하여 영구적인 금지명령을 내림.
# 사례2 : FDA의 요청에 따라 2017년에 미국 법원 집행관들은 캘리포니아의 회사에서 천연두백신을 압수함. 이 회사는 암 치료법을 만들기 위하여 줄기세포와 혼합함. 허가를 받지 않은 제품을 클리닉에 배포하고, 환자의 종양과 혈액에 주사하여, 환자에게 심장의 염증과 부종 등의 부작용을 겪게 할 위험에 빠뜨림.
# 사례3 : 2018년에는 정형외과 의사가 제대혈에서 추출한 오염된 줄기세포치료제를 주사한 후 3개 주에서 최소 13명이 세균감염으로 입원함. FDA 조사관들은 캘리포니아에 본부를 둔 제조시설에서 위반사항을 발견함.
FDA는 충분한 집행수단을 사용하여 효과적으로 감독하기 위한 토대를 구축하여야 함. 집행수단에는 ① 치료제를 제조하거나 공급하는 업체 조사, ② 허가받지 않은 제품을 회수하고, 그 제품의 제조를 중단하도록 업체에 요구하는 명령, ③ 제조 및 품질관리기준을 준수하지 않거나 근거 없는 건강 광고 문구를 만드는 업체에 대한 경고장, ④ 법률을 위반한 사람이 책임지도록 보장하는 벌금, 법원 중단명령, 필요한 경우 형사고발을 포함하여야 함.
